This paper analyzes the legal response to animal abandonment in the Republic of Serbia, with particular emphasis on the existing normative framework and penal policy. In domestic law, animal abandonment is defined as a misdemeanor under the Animal Welfare Act, while criminallaw protection in this segment is absent. The paper examines the adequacy of the prescribed sanctions, the possibilities of their practical application and the necessary conditions for their effective enforcement, as well as the question of whether animal abandonment may fall within the concept of animal abuse within the meaning of the Criminal Code. Particular attention is devoted to penal policy in practice and its appropriateness in relation to the social harmfulness of this phenomenon and the consequences that animal abandonment produces, both for animal welfare and for the wider social community. The paper also includes a comparative overview of legal solutions in certain European countries, with the aim of indicating possible directions for improving domestic legislation.
