As “basic substances” were created at plant protection product EC Regulation 1107/2009 (PPP) generated significant expectation for light compounds and substances used by farmers and amateurs in gardens to get some of their useful light plant protection tools approved. Together, the claims of light approval dossiers and the sentence “For the purpose of this Regulation, an active substance which fulfils the criteria of a ‘foodstuff’ as defined in Article 2 of Regulation (EC) No 178/2002 shall be considered as a basic substance” generated some hope for fast approval of common substances especially foodstuff like milk, whey and plant extracts from food with no limitation of human inventiveness. However, during the last 15 years of diverse applications, even when official food/foodstuffs substances were applied, numerous allowed food/foodstuffs sold in EU were finally rejected, even with a relatively neutral EFSA outcome. At times, certain less EFSA compelling allegations regarding this final outcome were prioritized in arguments against approval. Worse still, basic substances applicant that were ultimately denied approval for officially “serious reasons” or “danger” for consumer were never subjected to further questioning, nor were they withdrawn from the food/foodstuffs EU market. This creates a status distortion for the same substances between Food Regulation EC 178/2002 and the PPP regulation.
