Communal land tenure in Mexico –historically conceived as collective and inalienable spaces– is currently facing significant legal and social challenges resulting from reforms that have enabled its incorporation into the market and restricted equitable access to its natural resources. Decisions made by ejido assemblies, often oriented toward commercial use through the transfer of rights, may adversely affect Indigenous peoples and the environment, undermining collective rights and the ecological functions of these lands. The overlap between communal and Indigenous territories demands compliance with national and international legal frameworks that uphold self-determination and territorial rights. Moreover, the right to a healthy environment requires the preservation of the essential ecological functions of these lands, placing limits on their exploitation. A regulatory rethinking is urgently needed –one that integrates agrarian, Indigenous, and environmental perspectives– fostering participatory and sustainable management to ensure the protection of communal lands for present and future generations.
