Key messages: There are no objective reasons to reassess the relevance of the Nature Directives. The Nature Directives face an implementation deficit, and consequently, they are necessary more than ever. Legal uncertainty stems from non-compliance with the Nature Directives, not from the Directives themselves. Non-compliance should not be ‘rewarded’ by weakening the Nature Directives. The Nature Directives are legally balanced, proportionate and flexible. The stress test is based on the wrong assumptions that nature conservation hinders competitiveness and is not cost-effective. Weakening the Nature Directives undermines the overarching objectives of the EU. Lowering the protection level of Europe’s nature is against the EU treaties and other EU law and policies.
