Abstract This chapter describes Article 47 of the 1986 Vienna Convention on the Law of Treaties (VCLT), which deals with specific restrictions on authority to express the consent of a State or an international organization. The wording of Article 47 of the 1986 Convention is almost identical to its equivalent in the 1969 Convention, the only difference being that the representative is now either of a State or of an international organization, and that the notification requirement applies also to other ‘negotiating organizations’. The rationale behind the provision also remains the same, namely to guarantee the stability of international agreements, whether these are between states or international organizations or both. By employing the same terminology, namely the ‘expression of consent’, for representatives of international organizations as is used for representatives of states, Article 47 formally analogizes their competencies. While this classification eventually prevailed, it was subject to some discussion within the Commission.
