This chapter does two things; first, it introduces the ‘property torts’, and second, it considers the role of tort law in light of these opening quotes taken from Weir. The second element is dealt with first. The analytical approach taken in this book focuses on the underlying role of tort law and the implication of having an action classified as tortious as both a problem and a possible solution. As such, this chapter provides a foundation for the critique and the proposals suggested therein by considering two opposing views of tort law. The chapter then introduces the five property torts that will be considered in this work; namely, conversion, trespass to goods, trespass to land, private nuisance (including Rylands v Fletcher ), and negligence (as far as it relates to property damage). It discusses their scope, how they operate, and briefly deals with any controversial and important aspects of the torts. The complexities and intricacies of the torts are further dealt with in following chapters.
