EnglishThe current migration processes, becoming more and more a crucial social issue, require adequate defensive guarantees in favour of the accused speaking a foreign language, in order to ensure that the criminal trial is fair and free from unequal treatment. Through the judgement in subject, the Judges of the Supreme Court overtake the lack of a proper normative framework sanctioning the omission and affirm that the absence of the translation of a judgement represents a limit for it to become final; in this way they guarantee that the infringement of a duty provided by the revised art. 143 of the Italian Criminal Procedure Code does not preclude the enforcement of the right to defence of the accused speaking a foreign language. italianoI processi migratori in atto, tema di scottante attualita, comportano anche per il processo penale, che aspiri ad essere equo e scevro da trattamenti ineguali, la necessita di assicurare concretamente le garanzie difensive nei confronti dell’imputato alloglotto. Con la decisione in esame, pur in assenza di un quadro normativo che sanzioni l’omissione, i Giudici di legittimita affermano che la mancata traduzione della sentenza opera come limite al suo passaggio in giudicato e pongono le basi per garantire che la violazione dell’obbligo sancito dal novellato art. 143 c.p.p. non pregiudichi l’esercizio dei diritti di difesa dell’imputato straniero.
