Case can't be applied in China because of its conflicting with the law tradition of China. The virtues of case law can't be available .The system of precedent acquires the good characters of case law and waves its shortcomings. And with that characters, the system of precedent occupy the qualification to be applied in China. Now, with the mutual penetrating of the two legal system and the judicial reforming of China, it is significant to develop the system of precedent in whole of China that belongs to the Roman Law Legal System
